One of the most common questions we get asked in the early stages of a claim is how much is my personal injury claim worth?
Each personal injury claim is different and it's not possible to predict an exact figure. However, based on the facts you have provided we are often able to suggest whether your claim may be a low value personal injury claim (less than £25,000) or a higher value claim suitable for allocation to the intermediate track (£25,000-£100,000) or the multi-track (£100,000+). However, the intermediate track was introduced fairly recently. For cases where the cause of action was prior to 1st October 2023, claims suitable for the multi-track are those valued over £25,000. Of course, the figures we provide, particularly in the early stages are just an estimate and are dependent on further expert evidence that will assist with quantum.
Our estimates are based on the figures provided within the 16th Edition of the Judicial College Guidelines, this is a legal reference text provided by the Judicial College, part of the Ministry of Justice.
The Judicial College Guidelines act as a starting point to assessing general damages for pain, suffering and loss of amenity and specialist medical evidence from the relevant expert will assist in determining the extent of your injuries and the value of your claim. It is important to remember that a personal injury claim is made up of two parts and the pain and suffering from the injuries themselves only forms one part of a claim for compensation. Special damages are further financial losses because of your injury and can include the following:
• Time off work due to your injuries
• Loss of pension payments
• Travel costs
• Damaged belongings
• Aids and appliances to support recovery
• Treatment costs
• Care
