When making a claim for compensation for personal injury, collecting evidence is vital. Whilst in practice this may seem relatively straightforward, there are different types of evidence required depending on the type of personal injury suffered.
As a claimant, below is examples of the evidence you can obtain to assist your solicitor when pursuing a personal injury claim.
In the aftermath of an accident, often the scene or location of the accident will provide useful evidence, whether this is an uneven surface, faulty machinery or tyre marks on the road, photo evidence often assists in establishing who is at fault.
In the case of road traffic collisions and slipping/tripping accidents the scene is often restored to one that is safe to prevent future accidents, so evidence can be ‘lost’ if photographs are not taken. If there are witnesses to your accident, ensure you get their contact details and if for any reason you are unable to take photos, recreating a diagram of the scene soon after the accident, whilst the events are fresh in your mind can be useful at a later date.
Whilst your solicitor will arrange for you to be examined by a medical expert, obtain your medical records and necessary police/accident reports in due course, it’s a good idea to take photos of the injuries you sustained as soon as possible. Additionally, photos of physical items that were lost in the accident such as torn clothing or damaged personal property.
As time progresses, keep a diary/ record of your injuries, all too often we see injuries that initially appear to be minor escalate into more serious injuries or conditions.
If family and friends are having to provide more care and support to you as a result of your injuries, document what support they are giving you, whether this is help getting washed and dressed, domestic chores, shopping or even general home maintenance and DIY.
Lastly, keep receipts of any expenses incurred as a result of your injuries. This can be prescription costs or public transport/ mileage costs incurred as a result of attending appointments.
Providing your solicitor with the above evidence can be pivotal in establishing liability and negotiating settlement of your claim.
