A running theme of this blog is the lack of consumer protection when using unregulated legal services providers (see here and here and here).
We have also previously touched upon an area that I had considered effectively confined to dusty shelves of the academia (Donatio Mortis Causa – see here)
We even covered the difficulties of witnessing a Will over Covid, and the vagaries of the remote witnessing statutory ‘fix’ (here).
It was therefore with some intrigue that I read of a recent case that seemingly brings together all of these disparate strands into one omni-shambles of a case (which I am pleased to say appears to have reached an equitable and just conclusion in the face of a unique set of circumstances).
That case was concisely covered in the Gazette here and I would highly commend the article to anyone interested in private client law.
Naturally, it is not ideal to leave your last Will to a tardy Will writer or, indeed, the last minute. If you would like to discuss your own estate planning or Wills, please do not hesitate to contact the writer by email or on 01494 893 533.
