Trust litigation

Our lawyers have experience of advising in relation to high value trust litigation, acting both for and against trustees.  We understand the sensitive nature of trust disputes and work with our clients to resolve disputes at an early stage.  Where that is not possible, we expertly guide our clients through the litigation process.

We are able to help you with many aspects of trust litigation, including:-

  • breach of trust claims;

  • commercial disputes involving trusts;

  • variation of trust applications;

  • directions for the administration of trusts;

  • removal of trustees;

  • asset tracing;

  • litigation concerning the rights of beneficiaries/creditors; and

  • constructive trust claims.

Our team is highly specialised in contentious trusts and probate.  Toby Walker, Partner and Head of Dispute Resolution, is a member of ACTAPS – The Association of Contentious Trust and Probate Specialists. Charlotte Braham (Senior Associate) and Kezia Brown (Associate Solicitor) are each members of the Contentious Trusts Associate (ConTra).  In 2023, Charlotte gained a distinction in an Advanced Certificate in Contentious Trusts from the Society for Trust and Estate Practitioners (STEP).
